Consent Notice (DPDP)
Effective 1 June 2026 · VAI/POL/2026/CON-001 v1.0 · Digital Personal Data Protection Act, 2023
This page reproduces the consent notice and the consent choices that are presented to you during the Nirmaan AI enrolment flow, so that you can review them here before you enrol.
It is read together with our Privacy Policy (VAI/POL/2026/PP-001), which is the primary source for the description of the categories of data we collect, our processing purposes, and the rights available to you.
1. Purpose and Scope
This document sets out the legal framework under which Vasudhaiva AI Solutions LLP ("Vasudhaiva", "we", "us", or "our") obtains consent from participants for processing personal data on the Nirmaan AI platform, in compliance with the Digital Personal Data Protection Act, 2023 (the "DPDP Act"), and it specifies the exact notice text and consent toggle text presented to participants in the Nirmaan AI enrolment flow.
This document must be read together with the Nirmaan AI Privacy Policy (VAI/POL/2026/PP-001) and the Terms of Service (VAI/POL/2026/TOS-001). Where this document and the Privacy Policy describe overlapping matters, the Privacy Policy is the primary source for the description of categories of data, processing purposes, and rights; this document is the primary source for the consent mechanics.
2. Consent Requirements under the DPDP Act
Under Section 6 of the DPDP Act, consent for the processing of personal data must be: (a) free, (b) specific, (c) informed, (d) unconditional, (e) unambiguous, and (f) given by clear affirmative action. Each of these qualities is operationalised in the consent design specified in this document, as follows:
- Free: no consent is required for participation in optional services that do not depend on it; the participant can decline optional consents and still proceed with the core Nirmaan AI programme. Mandatory consents are limited to those necessary for delivery of the programme.
- Specific: each processing activity for which consent is sought has its own toggle. Bundled consent (a single "I agree" for all purposes) is not used.
- Informed: each toggle is accompanied by helper text explaining what is being consented to, in plain language. A link to the Privacy Policy is presented immediately adjacent.
- Unconditional: no consent is contingent on the participant accepting a different, unrelated consent. The toggles operate independently.
- Unambiguous: each toggle is a clearly-labelled checkbox in the unchecked state by default. The participant’s affirmative action of checking the toggle is what records consent.
- Clear affirmative action: pre-checked toggles, dark patterns, or implied consent from continued use are not used. The participant must take the affirmative step of checking the toggle.
Section 5 of the DPDP Act requires that, on or before requesting consent, the data fiduciary provide the data principal with a notice that describes the personal data and the purpose of processing, and informs the data principal of the rights available, including the right to grievance redressal and to make a complaint to the Data Protection Board of India. The notice text required by Section 5 is set out at the next section of this document.
3. The Consent Notice
The following notice is presented to the participant on the consent screen of the Nirmaan AI enrolment flow, immediately above the consent toggles. Before you enrol, please read this short notice. It explains who we are, what information we collect, why we use it, and the rights you have. The full detail is in our Privacy Policy.
Who collects your information
Vasudhaiva AI Solutions LLP (LLPIN ACL-1443), a Limited Liability Partnership at Vadodara, Gujarat, India. We are the Data Fiduciary in respect of your personal data on Nirmaan AI.
What we collect
Your name, contact details, current professional or academic status, domain of interest, target role and goals, payment details (handled by the payment gateway, not stored by us), your project submissions, your interactions with the AI Mentor, and technical data about your use of the platform.
Why we use it
To deliver the Nirmaan AI programme to you, including AI-generated project briefs, review feedback, AI Mentor conversations, certificate issuance, and portfolio publication. AI processing involves transfer of your personal data to AI providers (OpenAI and Anthropic) outside India. We may also send you service notifications, and (if you opt in) marketing communications.
Your rights
You can access your data, correct it, ask for it to be erased, withdraw any consent you give, and nominate someone to act on your behalf. You can raise a grievance with our Grievance Officer at legal@vasudhaiva.ai. If unresolved, you can complain to the Data Protection Board of India.
Withdrawal
You can withdraw any consent given here, at any time, from your account settings. Withdrawal does not affect what we have lawfully done before withdrawal. If you withdraw consent needed for the programme, we may need to end your access.
Languages
This notice is available in English and in the Eighth Schedule languages, accessible via the language selector on the consent screen.
The notice and the consent toggles together discharge the data fiduciary’s obligations under Sections 5 and 6 of the DPDP Act in respect of the consent-based processing activities of Nirmaan AI.
4. The Consent Choices
Five consent toggles are presented to the participant at enrolment, in the order below. Two are mandatory for participation in Nirmaan AI; three are optional. Each toggle is a separate checkbox, unchecked by default, with the label and helper text set out below.
| Consent | What it covers | Required to enrol? |
|---|---|---|
| I agree to the processing of my personal data by Vasudhaiva AI Solutions LLP for the delivery of the Nirmaan AI programme. | Required to enrol. This covers your account creation, AI-generated project briefs and review feedback, AI Mentor conversations, certificate issuance, and your portfolio. Full detail is in our Privacy Policy. | Required |
| I consent to the transfer of my personal data outside India for AI processing by OpenAI, Anthropic, and (where I enable voice mode) ElevenLabs, located in the United States. | Required to enrol. Nirmaan AI relies on these AI providers to generate project briefs, review feedback, AI Mentor responses, and placement reports. Without this consent, the programme cannot be delivered. Read more in our Privacy Policy clause 8. | Required |
| I opt in to receive Nirmaan AI service notifications on WhatsApp. | Optional. Covers programme reminders, feedback alerts, certificate availability, and account-related messages. We will not send marketing messages via WhatsApp unless you separately opt in at the next toggle. You can opt out anytime by replying STOP. | Optional |
| I would like to receive marketing communications from Nirmaan AI, by email and (if I have opted in above) WhatsApp. | Optional. Covers programme launches, feature updates, offers, and Vasudhaiva news. You can withdraw this consent at any time from your account settings, or by clicking unsubscribe in any marketing email. | Optional |
| I consent to Vasudhaiva using irreversibly anonymised versions of my project submissions to improve the Nirmaan AI platform. | Optional. Anonymisation means your name, identifiers, and any personal data are removed before the submission is used for any platform improvement. You can withdraw at any time. Withdrawal does not affect anonymised data already in use. | Optional |
5. Withdrawal of Consent
Each consent given on the enrolment screen is revocable. The participant may withdraw any consent through the consent management controls in account settings, or by writing to legal@vasudhaiva.ai.
Withdrawal of the consents given at the two mandatory toggles cannot be effected while the participant remains an active member of the Nirmaan AI programme. Such withdrawal is treated as a request to end participation, in line with the Cancellation Policy (VAI/POL/2026/CAN-001). The Refund Policy (VAI/POL/2026/RP-001) governs the refund consequences.
Withdrawal of any optional consent takes effect within seven (7) Working Days of receipt of the withdrawal request, save where the relevant flow can be turned off instantly through account settings, in which case the effect is immediate. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
6. Consent for Minors
Where, in accordance with the Terms of Service, Vasudhaiva permits enrolment by an individual between sixteen (16) and seventeen (17) years of age, verifiable consent of a parent or lawful guardian is required, in the manner contemplated by Section 9 of the DPDP Act. The mechanics of verifiable parental consent will be implemented in line with the Rules to be notified under the DPDP Act, and the design will be reviewed and updated at that point. Until those Rules are notified, the default position is that enrolment is restricted to individuals aged 18 or older, and the minor consent flow is not active. Where it is later activated, this document will be updated to specify the verifiable-consent mechanism.
7. Changes to this Notice
Where the consent suite is materially amended (for example, where a new mandatory consent is added, an optional consent is removed, or the helper text is materially changed), we will give at least thirty (30) days’ notice to existing participants by email and by a prominent notice on Nirmaan AI. Existing participants will be required to re-consent, in respect of any new mandatory consent, before continuing to use the affected feature. Existing optional consents remain in effect until withdrawn, irrespective of cosmetic amendments to helper text.
Where the DPDP Rules notified by the Central Government require a different consent design (for example, prescribed notice format, prescribed language requirements, prescribed verifiable-parental-consent mechanism), the consent suite will be updated to comply. Such updates do not require participant re-consent unless the change is material in substance.
